The regulations after Brexit

The United Kingdom left the European Union on 31 January 2020. EU free movement rules continued to apply during the transition period, which ended at 11pm on 31 December 2020.

The Immigration (European Economic Area) Regulations 2016 were revoked at the end of that transition period, but saving and transitional provisions preserve their application for certain purposes, including some outstanding applications and appeals. The regulations also remain relevant when assessing residence acquired before the end of the transition period and rights protected by the Withdrawal Agreement.

This site provides a reference to the regulations, which implemented Directive 2004/38/EC in the UK, and related case law. The text should be read alongside the applicable post-Brexit legislation and current Home Office guidance.
